TERMS & CONDITIONS

The purchase of any travel services offered by Indigo Explorer constitutes a contractual arrangement between you and  Indigo Explorer, and represents your acceptance of the Indigo Explorer Terms & Conditions set out herein. Please ensure that you read carefully and understand these Terms & Conditions prior to booking.​

 

 

Deposit, Payment and Cancellation Policy

Indigo Explorer is built on three core values: excellence, authenticity, communauty . We create un-expected experiences that make use of intimacy, exclusivity and even a touch of daring. We will can take you to the less-known destinations to encounter the least expected; we also know how and where you can gain the freshest, most fabulous perspectives on famous landmarks.

Our travel designers are trained in the fine art of taking your aspirations, noting your specific needs and designing something very special.

 

 

Deposit and Final Payment

A non-refundable, non-transferable deposit of 25% is required. Note that bookings are not confirmed nor secure until Indigo Explorer receives this deposit and you receive a confirmation invoice. Indigo Explorer reserves the right to release or cancel any bookings being held where this required deposit has not been received by the deposit due date. Payment of the deposit indicates you have read and accepted these

 

Terms and Conditions.

Please review and verify your booking invoice thoroughly and contact us immediately if your invoice appears to be incorrect or incomplete, as it may not be possible to make changes later. Indigo Explorer cannot accept responsibility if we are not notified of inaccuracies within 5 days of sending out the invoice. In the case of billing errors, Indigo Explorer reserves the right to re-invoice you with correct pricing.

Final payment for your booking is due 45 days prior to commencement of services. If final payment is not received by the due date, your reservation will be cancelled and Indigo Explorer will retain your full deposit. Indigo Explorer is not responsible for cancelled land and/or air reservations in the event payment is not received by the final payment date. If a booking is made within 30 days prior to arrival, full payment will be required at the time of booking.

All payments shall be made either by credit card or telegraphic transfer to the appropriate account:

Cancellation By You

If Indigo Explorer receives a booking cancellation prior to the final payment date of a participant’s vacation, 25% of a participant’s trip costs will be retained as cancellation fee. Cancellation fees as stated below apply to all booking cancellations.

  • 90 - 46 days prior to arrival a 25% cancellation fee will apply

  • 45 - 22 days prior to arrival a 50% cancellation fee will apply

  • 21 - 0 days prior to arrival a 100% cancellation fee will apply

Refund of Unused Services

No refunds or exchanges can be made in respect of accommodation, meals, sightseeing tours, transport or any other services that are included in the tour pieces but not utilized by the tour member.

Payment Methods

Indigo Explorer offers a range of payment options via credit card and telegraphic transfers, in US Dollars (USD). They are listed below in their ease of payment for both participant and Indigo Explorer and any credit card and/or bank transfer fees will be borne by participants.

  1. Secure online money transfer service via Transferwise (currency USD, fast and lower fees than most bank)

  2. Bank telegraphic transfer (currency USD)

Force Majeure

If as a consequence of 'Force Majeure' as defined below, Indigo Explorer is obliged to curtail, alter, extend or cancel the tour, the customer shall not be at liberty to maintain a claim for compensation or otherwise for any loss arising as a consequence of said curtailment, alteration, extension or cancellation of the tour. 'Force Majeure' means Acts of God, natural disasters, adverse weather conditions, fire or other destruction of any vessel, craft or vehicle to be used in connection with a holiday, destruction or damage to holiday accommodation, riots, acts of war, civil commotion, exercise of legislative or government action, municipal or military or other authority, strikes, industrial action, requisition of equipment, mechanical breakdown, shortage of fuel, insolvency or default of any carrier or service connected with the tour, fraud perpetrated against Indigo Explorer.

 

 

Acceptance and Risk

The Client acknowledges that the nature of the trip is adventurous and participation involves a degree of personal risk. The Client will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However it is also the Client’s own responsibility to acquaint himself with all possible relevant travel information and the nature of his itinerary. The Client acknowledges that his decision to travel is made in light of consideration of this information and accepts that he is aware of the personal risks attendant upon such travel.

 

 

Indigo Explorer and its Third Party Supplier

Indigo Explorer makes arrangements with accommodation providers, activity providers, transfer operators, tour and local guides, and other independent parties (“Third Party Suppliers”) to provide the Client with the travel services and other services the Client purchases or which form the component parts of the Client’s product Tour. Third Party Suppliers may also engage the services of local operators and/or sub-contractors for the provision of travel services that form part of the product Tour(s). Although Indigo Explorer takes all reasonable care in selecting Third Party Suppliers, Indigo Explorer is unable to control Third Party Suppliers and do not supervise Third Party Suppliers and therefore cannot be responsible for their acts or omissions. The travel services and other services provided are subject to the conditions imposed by these suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services. These may limit or exclude liability of the supplier. The Client acknowledges that Third Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and Indigo Explorer does not warrant that any Third Party Supplier is in compliance with the laws of the Client's country of residence, or any other jurisdiction.

INDIGO EXPLORER IS NOT LIABLE AND WILL NOT ASSUME RESPONSIBILITY FOR ANY CLAIMS, LOSSES, DAMAGES, COSTS OR EXPENSES ARISING OUT OF INCONVENIENCE, LOSS OF ENJOYMENT, UPSET, DISAPPOINTMENT, DISTRESS OR FRUSTRATION, WHETHER PHYSICAL OR MENTAL, RESULTING FROM THE ACT OR OMISSION OF ANY PARTY OTHER THAN INDIGO EXPLORER AND ITS EMPLOYEES.

For clarity, neither Indigo Explorer nor any carrier is liable for the acts or omissions, whether negligent or otherwise, of Third Party Suppliers or any independent contractors.

Passport, Visa and Immigration Requirements

It is your responsibility to fulfill the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.

Travel Insurance

Participant is strongly recommended to purchase a comprehensive personal travel insurance policy for the duration of the trip to cover against personal accident, loss of baggage, flight delays and/or cancellation, unexpected alterations to travel arrangements, act of God, emergency medical evacuation, infectious diseases, epidemics, terrorism etc.
